Toll charged over forklift injury

WORKSAFE has charged Toll Transport after a forklift incident at their Perth Airport premises left a worker with serious and permanent injuries to their legs.

The incident occurred in January 2021 when a worker was tasked with placing stickers on the floor to delineate bays for deliveries to different mine sites.

Worksafe alleges that while the worker was performing their duties, a forklift reversed into them and drove over their left foot and right leg.

Worksafe contends that Toll did not implement practical measures to keep employees safe, leading to a charge of failing to provide and maintain safe workplace and, by that failure, causing harm to an employee.

Toll was also charged with failing to ensure that movement and speed of vehicles and plant at the workplace were managed in a way that minimised risk to pedestrians.

If convicted, Toll faces up to $2 million in fines.

The case’s first mention will take place on February 16 at Perth Magistrates Court.
