SAT sets North Stoneville date

The State Administrative Tribunal has scheduled the final hearing for the controversial North Stoneville SP34 proposal on November 3 next year.

THE State Administrative Tribunal has listed the controversial North Stoneville SP34 proposal for a final hearing on November 3 next year.

The latest SAT orders said that by Friday, November 29 this year Satterley must file with the tribunal and give to the Western Australian Planning Commission (WAPC) its own statement of issues, facts and contentions setting out (a) by reference to each paragraph number in the WAPC’s updated statement (dated October 25) whether Satterley accepts or rejects the issue, fact or contention identified by the WAPC and (b) any other issues, facts and contentions it says are relevant to the decision under review.

Satterley must at the time of filing and providing its statement of issues, facts and contentions file with the tribunal and give to the WAPC an indexed and paginated bundle in chronological or other logical order of the documents on which it proposes to rely in the proceeding not in the WAPC’s bundle.

By December 19, in order to attempt to narrow the scope of the issues in dispute in the matter and to confirm the remaining issues for determination in the matter, the parties are to confer in relation to (a) issue B5 (bushfire policy framework) identified in paragraph 21, page 14, of the WAPC’s updated statement and (b) the implications of the approval dated September 16 granted under the Environment Protection and Biodiversity Conservation Act 1999 (Cth).

SAT said any application to intervene under s 37(3) of the State Administrative Tribunal Act 2004 or to make submissions under s 242 of the Planning and Development Act 2005 was to be made by December 13.

A Save Perth Hills spokeswoman said the the association was in the process of finalising formal position statements in relation to (a) issue B5 (Bushfire Policy Framework) identified in paragraph 21, page 14, of the Respondent’s updated statement and (b) the implications of the approval dated 16 September 2024 granted under the Environment Protection and Biodiversity Conservation Act 1999 (Cth) matters (and others), as they have their annual general meeting next week.

“The application to intervene is due by SAT on December 13, which we’re working towards at the moment,” she said.
